License FAQ

Kakou Collective product licenses are broken into 4 different types: Freebies, Standard, Extended, and Commercial. 

• Freebies apply to artwork that can be downloaded at no cost INCLUDING items from the Kakou Collective Vault (for Patrons and Instagram subscribers), and free monthly downloadable artwork (available in our monthly download tab and sent directly to email subscribers). 
• Standard Licenses apply to products purchased through Kakou Collective’s product page. 
• You must contact us directly for an Extended License or Commercial License, as each design is made with intention and licensing is determined based on artwork availability and relationship.
• All artwork is the property of Kakou Collective, LLC and artist, Kea Peters. Improper use of artwork is a direct violation of copyright law.
• Credit is greatly appreciated. Please tag us on Instagram or send a picture of what you create to aloha@kakoucollective.com. We love seeing what you create with our freebies!

Listed below are details of each license (Freebies, Standard, extended, and commercial). If you have any questions or need any further clarity, feel free to contact us for written approval.

• There are 4 Kakou Collective License types: Freebies, Standard, Extended, and commercial.
• Items may be used/installed on one computer per Standard/Extended License.
• Standard Licenses are for personal use in items not intended for sale.
• Using an item for business purposes? You’ll need an Extended License or Commercial License.

• The word product can be in reference to artwork (as an artwork is the product being purchased)

Freebie License Rights

All free resources available on KakouCollective.com are free for use in all personal projects.

Free License

• Can be used without limit for personal uses, or educational purposes which are offered for free (Examples of acceptable uses: flyers, invitations, gifts for family members, posts, covers, presentations, class projects, home projects.)
• Can not be altered, redistributed, or sold as if they are your own.
• Can not be used to create finished goods to be sold.
• Can not be used as part of a freebie offered elsewhere.
• If sharing a freebie, you must link to KakouCollective.com and not the download itself.
• If you would like to use the freebies for commercial purposes, you must Contact us.

• Personal and educational use is ok
• Credit must be given to Kakou Collective when possible

Standard License Rights

Applies to items purchased which are to be used in personal projects not intended for sale. Business usages are not permitted under the Standard License (please see Extended License details).

The Standard License grants you ongoing permission to use the Item to create personal use end products that are not intended to be sold. For the purposes of this Standard License, ‘sold’ means you plan to sell, license, sub-license or distribute the end product for any type of fee or charge.

Standard License

• Personal use only.
• One license per computer.
• You may modify or manipulate the Item, or incorporate it into other content and make a derivative work from it, without degrading the integrity of the original artwork (eg. turn it into a boarder, add text within or next to the artwork)
• You may use the Item in a new end product so long as it is not used alone, but instead as elements or parts of a new design (regardless of how much the item has been modified or how much of the new design it makes up - eg. a worksheet or part of a name tag)
• You may not sublicense, resell, share, transfer, or otherwise redistribute the Item on its own (e.g. as stock, in a tool or template, with source files, and/or not incorporated into an end product) under any circumstances, not even for free.
• You may not sell the end product, or sell access to the end product. If you want to sell the end product, you must purchase an Extended License.
• You may not use the item for business purposes, e.g. advertising, promotions, packaging, etc. You must purchase the extended license for all business related needs. 
• You may use the item for educational purposes (schools may use for advertising, promotions etc.)
• You may not make the Item available on a digital asset management system, shared drive, or the like for the purposes of sharing or transferring the Item, and you must not permit an end user of the end product to extract the Item and use it separately from the end product.
• You may not publicly display the Item: (a) as a standalone file in any digital format on the internet; or (b) in any digital format without imposing technical or written restrictions to prevent the unauthorized use of the Item by third parties. You agree to take all commercially reasonable steps to prevent third parties from accessing and/or duplicating the Item.
• You may not register as a trademark the Item or the end product incorporating the Item – not even logos. All artwork is © Kakou Collective by Kea Peters.
• You may not falsely represent, expressly or by way of reasonable implication, that any Item was created by you or a person other than Kakou Collective (the copyright holder) or Kea Peters of that Item.
• Credit must be given to Kakou Collective when possible

Extended License Rights

An Extended License allows the item purchased to be used in artwork intended to be sold, or used for any business-related purposes.

An Extended License certificate comes with every Extended License purchase from Kakou Collective. The Extended License grants you ongoing permission to use the Item to create end products that are intended to be sold or used for business purposes (e.g. advertising, promotions, packaging, etc.). For the purposes of this Extended License, ‘sold’ means you plan to sell, license, sub-license or distribute the end product for any type of fee or charge. You may contact us for an Extended License Agreement.

Extended License

• The Extended License allows you to use Items in any manner permitted under the Standard License, and you may use Items to create end products that are intended to be sold or used for business purposes (e.g. advertising, promotions, packaging, etc.).
• You do not have the rights to resell the product as if it were your own.
• You do not have the rights to distribute the product with client proofs, or in unflattened files.
• You do not have the rights to share the product with clients or other designers (they must purchase their own extended or standard license).
• You do not have the rights to offer the product in a giveaway or promotion.
• Credit must be given to Kakou Collective when possible

Commercial License Rights

A Commercial License allows the item purchased to be used in artwork and product intended to be sold, or used for any business-related purposes, exclusive to a specific individual or business.

A Commercial License Agreement comes with every Commercial License made with Kakou Collective. The Commercial License grants you ongoing permission to use the Item for a predetermined period of time to create end products that are intended to be sold or used for business purposes (e.g. product, advertising, promotions, packaging, etc.). For the purposes of this Commercial License, ‘sold’ means you plan to sell, license, or distribute the end product for any type of fee or charge. You may contact us for an Commercial License Agreement.

Commercial License

• The Commercial License allows you to use Items in any manner permitted under the Standard License, and you may use Items to create end products that are intended to be sold or used for business purposes (e.g. advertising, promotions, packaging, etc.).
• You do not have the rights to resell the product as if it were your own.
• You do not have the rights to edit or alter product without permission.
• You do not have the rights to share the product with clients or other designers (they must purchase their own extended or standard license) without approval
• You do not have the rights to share the product
• You do not have the rights to offer the product in a giveaway or promotion without approval
• Credit must be given to Kakou Collective when possible

Agreeing to terms and conditions

By utilizing any artwork created by Kakou Collective, you are agreeing to comply with all terms and conditions of Kakou Collective, LLC which holds all intellectual property under protection of copyright and identify that you understand our licensing.
